The government approved the draft amendment in July 2026 Act No. 49/1997 Coll., on civil aviation, whose main goal is to reflect the new rules of European regulation into the Czech legal system Single European Sky and at the same time to amend some issues related to aviation safety. The proposal was subsequently submitted to the Chamber of Deputies on 7 August 2026.
The basis of the European regulation is Regulation (EU) 2024/2803 of the European Parliament and of the Council of 23 October 2024 on the implementation of the single European sky (hereinafter "ordinance"). Although directly applicable, it requires appropriate adaptations at national level.
Major changes
Strengthening the Civil Aviation Authority's oversight of air navigation services
The amendment defines the competence of the Civil Aviation Authority as the national supervisory authority over air navigation services under the Regulation. At the same time, it regulates the related administrative procedures and rules for imposing administrative sanctions.
Transfer of passenger data
According to the proposal, air carriers will be obliged to transfer passenger name record data to the Police of the Czech Republic at three points in time: the first time 48 hours before the scheduled departure time, then 24 hours before the scheduled departure time, and the third time immediately after passengers board the aircraft.
Reliability evidence
The new reliability certificates are to be issued for an indefinite period. The regular annual reliability review is maintained, but it will no longer be necessary to issue a new certificate after each review. In addition, it will be possible to issue the certificate in electronic form.
Administrative fees
The amendment also includes major changes to administrative fees in the field of civil aviation. For example, the fee for issuing a license to a domestic air carrier to operate scheduled commercial air transport is to be increased from CZK 80,000 to CZK 100,000.
It should be taken into account that the amendment is currently only at the beginning of the legislative process and its final wording may therefore change during the discussion.
