Did you know that property damage can occur without physical damage to the property? It is so! Damage already occurs at the time of the damage event, regardless of how the injured party disposes of the property (whether he sells it or not). This opinion was expressed by the Supreme Court of the Czech Republic in judgment no. 25 Cdo 1548/2020-429 of April 12.4.2022, XNUMX.

In this case, it was a question of devaluation of the housing unit. The property in question, where the apartment unit was located, was evacuated due to the formation of cracks (during the construction, the builder or the investor, who were the defendants in the case, used poor-quality material and based on incorrect calculations) and possible danger to persons. The whole matter was widely publicized, which significantly reduced the price of the housing unit in question, despite the fact that it subsequently turned out that the statics of the building as such are not at risk and it is not necessary to carry out any construction modifications.
