Effective from 2 August 2026 new rules in the field of AI, especially rules on transparencyThe legal regulation can be found in Article 50. Regulation (EU) 2024/1689 of the European Parliament and of the Council of 13 June 2024 (hereinafter referred to as the “AI Act”).
What are the changes?
The new rules introduce the following obligations in particular:
- inform individuals that they are communicating with an artificial intelligence system,
- ensure that certain outputs from AI systems are technically marked so that they can be identified as artificially created,
- inform the individuals concerned about the operation of emotion recognition systems or biometric categorization systems,
- publish information that the image, sound or audio-visual content representing the so-called "deep fake" has been artificially created or manipulated,
- in the case of an AI system that creates or manipulates text published for the purpose of informing the public about matters of public interest, state that it was artificially created or manipulated.
The information shall be provided to the natural persons concerned in a clear manner at the latest at the time of the first interaction with the AI system.
What is the risk of violation?
Providers face high fines for violating certain obligations set out in the AI Act. fines, which may amount to 3% of the total annual worldwide turnover of the preceding accounting period or EUR 15,000,000, whichever is the higher.
