Reduction of contractual penalty in case of early termination of the contract
If a consumer (or a natural person doing business) prematurely terminates a fixed-price contract, the contractual penalty may not exceed 40% from the amount he would have paid by the due end of the contract.
Changes when complaining about billing
According to the amendment, the supplier must file a billing complaint to be completed within 15 days at the latest from the date of its delivery. In the event of a delay in processing the complaint, the consumer is entitled to CZK 50 for each day of delay (max. CZK 5).
Introduction of the supplier's obligation to notify price reductions
According to the amendment, the supplier is now obliged to announce consumer or natural person doing business and any price reduction no later than 30 days before this reduction.
Introduction of the Secured Trader Index
The index shows what part of electricity or gas the trader has secured at a fixed or guaranteed price for the next 36 months. The trader must publish it twice a year and report it to the ERO at the same time. If the index is lower than 70% or not published, the consumer can terminate the fixed-price contract without any penalty.
