The amendment came into effect on 1 January 2026. Act No. 40/2009 Coll., Criminal CodeIn addition to modifying the facts and introducing new criminal offenses, the amendment also affects the penalties themselves.
The Criminal Code was amended 2 penalties added:
- prohibition of performing public contracts or participating in public tenders and
- prohibition of accepting subsidies and grants.
So far, we have only encountered both of the aforementioned punishments in Act No. 418/2011 Coll., on criminal liability of legal persons and proceedings against them.
It is now possible to impose these penalties not only on legal persons, but also also to natural personsThis will mainly concern cases where a natural person commits a crime when concluding a contract for the performance of public contracts or when performing them, but also when participating in a tender procedure or public competition.
