It came into effect on 1 June 2026 Decree No. 80/2026 Coll., which is changed Decree No. 154/2011 Coll., on military aviation, approval of the technical capability of military aviation, performance of regular technical inspections and tests of technical equipment of military aviation, operation and inspections of military aviation and authorization and certification of legal entities and individuals, and on the military aviation register (on military aviation).
What does the amendment bring?
The amendment to the Decree on Military Aviation Technology responds to changes in the field of defense, aims to simplify the conditions for the introduction and operation of military unmanned aircraft and introduces a new approach based on the assessment and evaluation of the level of riskIt is also inspired by the regulations of the EU or NATO member states, thus achieving better unification and modernization of practice.
The new risk-based categorization system will apply to all military drones, namely those operated by the armed forces of the Czech Republic and civilian operators (who participate, for example, in the training of military personnel).
Traffic category
- Open mode of operation – represent low risk to other traffic in airspace and for persons and property on the ground, are not subject to military aircraft type approval.
- Specific mode of operation – represent medium risk, are also not subject to military aircraft type approval.
- Certified mode of operation – represent high risk, subject to military aircraft type approval according to Act on the Armed Forces of the Czech Republic.
In a risk assessment, a military unmanned aircraft is considered comprehensively, not only technical parameters are examined, but also its capabilities (independent navigation, the ability to carry weapons, target targeting, etc.), all taking into account the method of use (reconnaissance, combat activities, transport of material, etc.) and operating conditions (flights during the day or night, in good or bad weather and visibility, etc.).
Changes to the annexes
The amendment to the decree on military aviation technology also includes a substantial change to the annexes, especially No. 6, 7 and 8.
Appendix No. 6 contains a list of restrictions set for military unmanned aircraft operated in open mode.
Appendix No. 7 defines (not exhaustive) the scope of the assessed areas and parameters.
Appendix No. 8 then it regulates the method and stages of risk assessment itself.
