The amendment is effective from 1 August 11 Act No. 49/1997 Coll., on civil aviation, which responds by changing the legal regulation to Regulation (EU) 2023/2405 of the European Parliament and of the Council of 18 October 2023 on ensuring a level playing field for sustainable aviation, which aims to address the requirements of the Union market in the field of aviation, in particular in the field of sustainable aviation fuel.
The amendment to the Civil Aviation Act itself mainly extends the possibility for air carriers to decide to be subject to the regulation even in cases where it would not otherwise applyThis option is possible when operating commercial air transport or other aviation activities, provided that they notify the Civil Aviation Authority of this fact. A similar option is available to and airport operators, who may also be included under the regime of the relevant regulation at the request of the Civil Aviation Authority.

The Regulation regime provides a uniform regulatory framework that reduces administrative uncertainty, increases the trust of business partners and allows carriers to better plan the fulfillment of obligations regarding sustainable aviation fuel. In addition, carriers can present their involvement in the scheme as part of their ESG strategy and commitment to sustainable operations, which is increasingly important when negotiating with airports, investors and corporate clients.
New obligations of the Customs Office
The Civil Aviation Authority is now also given additional tasks within its scope in accordance with the regulation and new facts of offenses are being introduced (for example, failure to report specified data to the Civil Aviation Authority or the European Aviation Safety Agency, failure to refuel the minimum amount of aviation fuel at a designated airport, or failure to provide the necessary cooperation to the airport operator).
