In the Czech Republic, the main administrative authority in the field of civil aviation is Civil Aviation Authority (hereinafter "UCL").

For example, it decides on:

  • organization approval (AOC, CAMO, Part-145, etc.)
  • aircraft registration
  • permits for the operation of airports and aviation structures
  • imposing sanctions for violations of aviation regulations

In addition to the ÚCL, however, other institutions also enter the proceedings, whose role depends on the nature of the matter. It may be the Ministry of Transport, building authorities dealing with protection zones, or the financial administration. Beyond the framework of national regulations, the European Agency EASA fundamentally influences the rules of the game.

Typical situations where administrative proceedings arise

Administrative proceedings in aviation can arise for various reasons. In practice, I most often encounter the following situations:

1. Licensing and permitting procedures

Without a decision from the office, a number of activities cannot be carried out, whether it concerns obtaining air carrier certificate (AOC), approval maintenance or training organization, or release pilot's license.

These procedures tend to be administratively demanding and require extensive documentation.

2. Sanction proceedings

The authority initiates it when there is suspicion of a violation of regulations, failure to comply with safety standards, failure to meet aircraft maintenance requirements, or violation of airport operation rules.

The result may be a fine or corrective measures.

3. Removing or restricting permissions

The most serious scenario is when the authority moves to restrict authorization, revoke the license, or suspend operations. Such a decision often has major economic and professional impacts.
